Please read carefully. These Terms & Conditions constitute a legally binding agreement between you and TanishElectronics Pvt. Ltd. By accessing our website or placing an order, you confirm that you have read, understood, and agree to be bound by these terms.

1. Acceptance of Terms

Welcome to TanishElectronics! These Terms & Conditions ("Terms") govern your use of the website TanishElectronics.in, any related mobile application, and all services provided by TanishElectronics Pvt. Ltd. ("Company", "we", "us", or "our"), a company incorporated under the laws of India.

By visiting, browsing, or making a purchase on our platform, you ("User", "Customer", "you") agree to these Terms in their entirety. If you do not agree, you must immediately stop using our platform.

We reserve the right to update these Terms at any time. The revised version will be effective upon posting, and continued use of our platform after any changes constitutes acceptance of the updated Terms.

2. Eligibility

To use our platform and place orders, you must:

Be at least 18 years of age or the legal age of majority in your jurisdiction
Have the legal capacity to enter into a binding contract under Indian law
Not be barred from receiving goods or services under any applicable law
Provide accurate, current, and complete information during registration and checkout

Minors may use our platform only under the supervision of a parent or legal guardian who agrees to these Terms on their behalf. By registering, you represent and warrant that you meet all eligibility requirements.

3. Your Account

When you create an account with TanishElectronics, you are responsible for:

Maintaining the confidentiality of your username and password
All activities that occur under your account, whether or not authorised by you
Promptly notifying us of any suspected unauthorised use of your account
Keeping your personal and payment details accurate and up-to-date

We reserve the right to suspend or permanently terminate accounts that violate these Terms, engage in fraudulent activity, or pose a security risk to our platform or other users.

You may not transfer your account to any third party. Accounts are personal and non-transferable.

4. Products & Pricing

Product descriptions: We strive to ensure that all product information, images, and specifications on our platform are accurate. However, we do not warrant that descriptions are error-free, complete, or current. Product colours may vary slightly depending on your display settings.

Pricing: All prices are listed in Indian Rupees (INR) and include applicable GST unless stated otherwise. Prices are subject to change without prior notice. The price applicable to your order is the price displayed at the time of placing the order.

Stock availability: All products are offered subject to availability. We reserve the right to limit quantities or discontinue any product at any time without prior notice.

Pricing errors: In the event of a pricing error (e.g., a product listed at ₹1 due to a technical glitch), we reserve the right to cancel the affected orders and issue a full refund. We will notify you by email if this occurs.

5. Orders & Payment

Order placement: Placing an item in your cart does not constitute a binding order. An order is confirmed only when you receive an Order Confirmation email from us with an order number.

Order acceptance: We reserve the right to refuse or cancel any order at our discretion, including situations involving:

Suspected fraud or misrepresentation
Unavailability of the product
Payment failure or authorisation issues
Errors in pricing or product descriptions
Delivery address outside our serviceable area

Payment: We accept UPI, credit/debit cards, net banking, and EMI options via our payment partner Razorpay. Cash on Delivery (COD) is available at select pin codes. By providing payment information, you represent that you are authorised to use that payment method.

GST Invoice: A tax invoice will be provided for every order as required under GST law. Ensure your GSTIN (if applicable) is added to your profile before placing the order.

6. Shipping & Delivery

Delivery timelines: We aim to ship orders within 1–2 business days of payment confirmation. Estimated delivery times (shown at checkout) are indicative and not guaranteed, as they depend on courier partners and your location.

Serviceable area: We currently ship across all major pin codes in India. Remote areas may have longer delivery times or restricted delivery options.

Risk of loss: Risk of loss and title to products pass to you upon delivery to the shipping address provided. We are not liable for delays caused by courier partners, natural calamities, strikes, or events beyond our control.

Failed delivery: If a delivery attempt fails due to an incorrect address or unavailability, the courier will make up to 2 additional attempts. After 3 failed attempts, the item may be returned to our warehouse; a re-shipment fee may apply for reattempts.

7. Returns, Refunds & Warranty

Our return and refund process is governed separately by our Return & Refund Policy, which forms an integral part of these Terms. Warranty claims are governed by our Warranty Policy. In the event of a conflict, the more specific policy shall prevail.

8. Intellectual Property

All content on TanishElectronics.in — including logos, brand names, product images, website design, text, graphics, software, and code — is the exclusive property of TanishElectronics Pvt. Ltd. or its licensors and is protected under Indian and international intellectual property laws.

You may not reproduce, copy, modify, create derivative works from, distribute, or commercially exploit any content from our platform without our explicit written permission. Personal, non-commercial use of content (e.g., saving a product image for your own reference) is permitted.

The "TanishElectronics" name and associated logos are registered trademarks. Unauthorised use of our trademarks is strictly prohibited.

9. Prohibited Use

You agree not to use our platform for any of the following:

Any unlawful purpose or in violation of any applicable Indian or international law
Submitting false, misleading, or fraudulent information at any stage
Placing bulk orders for resale without prior written authorisation
Circumventing, disabling, or interfering with security features of the platform
Scraping, harvesting, or extracting data using bots, crawlers, or automated tools
Transmitting spam, viruses, malware, or any harmful code
Impersonating another person or entity
Engaging in price manipulation or coupon abuse
Posting false or defamatory reviews about products or our business

Violation of these terms may result in immediate account termination, order cancellations, and legal action under the Indian Penal Code, IT Act 2000, or other applicable legislation.

10. Disclaimers

Our platform and products are provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to:

Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
Warranties that the platform will be available, uninterrupted, secure, or error-free
Warranties regarding the accuracy or completeness of product information

We are not responsible for any losses arising from your reliance on information provided on our platform. We recommend reading product manuals before use.

11. Limitation of Liability

To the maximum extent permitted by law, TanishElectronics Pvt. Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, data, goodwill, or business — arising from:

Your use of or inability to use our platform or products
Unauthorised access to or alteration of your data
Delays in shipment or delivery beyond our control
Actions of our third-party service providers (couriers, payment gateways)

In any event, our total liability to you for any claim arising from your use of our platform or products shall not exceed the amount you paid for the specific product giving rise to the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless TanishElectronics Pvt. Ltd., its directors, employees, agents, and affiliates from any claim, liability, damage, loss, or expense (including reasonable legal fees) arising from:

Your breach of these Terms or any applicable law
Your use or misuse of our platform or products
Any content you submit, post, or transmit through our platform
Your violation of any third-party rights

13. Governing Law & Dispute Resolution

Jurisdiction: Courts at Haryana, India

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these Terms or your use of our platform shall be subject to the exclusive jurisdiction of the courts located in Haryana, India.

Dispute resolution process:

Step 1 — Informal resolution: Contact our support team. Most issues are resolved within 5 business days.
Step 2 — Consumer Forum: If unresolved, you may approach the appropriate Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019.
Step 3 — Arbitration: For commercial disputes, parties may agree to resolve through arbitration under the Arbitration and Conciliation Act, 1996.
